Thousands of records from the US State Department are set to be disclosed concerning a legal dispute involving Prince Harry’s US visa application. The Duke of Sussex has been caught in a legal battle since last year after a conservative Washington DC think tank, the Heritage Foundation, demanded the release of his visa paperwork in response to his disclosures of past drug use in his book, “Spare.”
Despite the courts upholding Harry’s privacy rights over his visa application, the Heritage Foundation initiated a new case against the US State Department to push for the release of other relevant documents. Following this, a total of 307 documents amounting to 2,487 pages were reviewed, and after extensive processing, the initial batch of files is scheduled for release by the end of July.
Upon reaching out to representatives of Prince Harry and the Heritage Foundation for comments, the US State Department declined to provide a statement citing ongoing litigation. The Heritage Foundation aims to uncover evidence supporting their allegations that Harry received preferential treatment from the US government during his visa application process.
Prince Harry and Meghan Markle made a permanent move to the United States in 2020 after stepping down from their royal duties. Attorneys for the Heritage Foundation argued in court that Harry may have either failed to disclose his past drug use or received favorable treatment during his visa application process.
In his autobiography “Spare,” published in 2023, Harry admitted to using drugs such as cannabis, cocaine, magic mushrooms, and ayahuasca, raising questions about his eligibility to enter the US. A joint court filing by the Heritage Foundation and the State Department in June indicated that the first release of relevant records is scheduled for July 2026, with subsequent releases every eight weeks thereafter.
This development could provide insight into how Prince Harry is perceived within the US government and shed light on the details of his visa application. The impending release of these documents follows a ruling in September 2024 by US District Judge Carl Nichols, which initially rejected the public’s strong interest in disclosing Harry’s immigration records, a decision challenged by the Heritage Foundation.
The Heritage Foundation’s legal team criticized the Biden administration for allegedly protecting Prince Harry, claiming that such actions undermine the public’s trust in immigration law enforcement. A representative of the Department of Homeland Security under the Biden administration emphasized that Harry’s book revelations do not constitute sworn testimony or proof, cautioning against unwarranted intrusion into the prince’s privacy.
Former US president Donald Trump expressed in a 2024 interview that Harry should not receive special treatment and should face consequences if found to have provided false information on his visa application. Trump emphasized the need for appropriate action if discrepancies related to drug use were uncovered.
