“Prime Minister-to-be Considers Excluding Child Sex Offenders from Sentencing Reform”

Andy Burnham is contemplating adjustments to prison sentencing reforms to exclude child sex offenders. The Prime Minister-to-be is reportedly troubled by proposals that could enable child groomers and rapists to qualify for early release starting September.

Members of Mr. Burnham’s team are exploring methods to prohibit child sex offenders from the program and assessing whether such modifications would necessitate primary legislation, as per a report by the Sunday Times.

The Sentencing Act, which was enacted earlier this year, stipulates that inmates serving sentences for certain violent or sexual crimes will be eligible for release halfway through their terms, instead of serving the current two-thirds requirement.

Included among prisoners who may be considered for release after serving one-third of their sentences under the new guidelines are criminals like burglars and thieves, a reduction from the current 40%.

Numerous prisoners are already exempt from the reform measures, such as those serving life sentences, terrorists, or murderers.

Portions of the Sentencing Act are set to take effect from September, potentially resulting in the early release of some offenders who were previously sentenced, contrary to judicial intent. Reportedly, the initial 700 convicts are slated for release in September.

The new system, termed an “earned progression” model and inspired by Texan prison practices, aims to alleviate prison overcrowding by releasing offenders earlier in their sentences.

The reform also involves the expanded use of technology, like electronic monitoring, to supervise offenders within the community and initiatives to assist criminals whose behavior stems from substance abuse, alcoholism, or mental health issues.

Former Home Office minister Jess Phillips, who resigned from the Government recently, advocated for an exemption within the scheme to ensure that individuals who have committed severe sexual offenses against children remain incarcerated.

During the campaign for the Makerfield by-election in May, Mr. Burnham expressed reservations about Labour’s proposal to eliminate jury trials for offenders expected to receive sentences of three years or less. He emphasized the importance of jury trials as a cornerstone of a fair society.

Regarding the sentencing reforms, a Ministry of Justice spokesperson emphasized the necessity of these actions to prevent prisons from reaching full capacity, which would disrupt the criminal justice system and endanger public safety. The spokesperson highlighted measures in place to prevent the early release of the most dangerous offenders and to impose stringent rules on released individuals to safeguard the public.

Justice Secretary David Lammy defended the reforms, asserting that they were essential to address the deficiencies in the prison system and ensure public safety. He criticized the previous government’s insufficient efforts to expand prison capacity, underscoring the importance of the Sentencing Bill and ongoing initiatives to increase the number of available prison spaces.
