“Olivia’s Law Enforces Court Appearance for Offenders”

Published on

A new law, named after the tragic death of nine-year-old Olivia Pratt-Korbel, has been enacted, compelling offenders to appear in court. Olivia was fatally shot by Thomas Cashman in August 2022 at her home in Dovecot, Merseyside. Cashman, a drug dealer, had pursued a rival who sought refuge in Olivia’s residence after her mother, Cheryl Korbel, opened the door.

Cashman received a life sentence, with a minimum of 42 years in April 2023, but he refused to attend his sentencing, prompting Olivia’s family to advocate for legal changes. Cheryl expressed her frustration at not being able to directly address Cashman during the court proceedings.

Under this new law, criminals who evade sentencing or disrupt court hearings may face extended imprisonment and other penalties, such as restrictions on family visits. The legislation, part of the Victims and Courts Bill, has been finalized and is awaiting Royal Assent.

In a statement from Olivia’s Butterfly Foundation, Cheryl and her family expressed gratitude for the support received during their campaign. They emphasized that the law would prevent other families from experiencing the denial of closure in court proceedings.

Cheryl met with MP Keir Starmer a year ago while pushing for the legal amendment. Starmer commended her determination to effect change, acknowledging that her efforts would resonate globally.

The bill, initially proposed by former Prime Minister Rishi Sunak, was a response to Cashman’s refusal to participate in court proceedings. Sunak assured Cheryl that the law would be amended to require offenders to be present during their sentencing to ensure accountability for their actions.
