“95-Year-Old Driver Gets Suspended Sentence for Fatal Crash”

A nonagenarian driver, aged 95, who struck and fatally injured a 78-year-old pedestrian outside a Tesco Express store has been given a suspended sentence instead of jail time. Joan Barwick, considered the oldest female driver involved in a fatal accident in the UK, hit Linda Wareham while turning her Vauxhall Corsa into a petrol station in Oldswinford, West Midlands.

Barwick admitted to causing death by dangerous driving and received a 16-month suspended sentence at Wolverhampton Crown Court. Prosecutors stated that Barwick, then 94, failed to pay attention as she was focused on an available disabled parking spot, not noticing Wareham walking with her dog. Despite slowing down to about 10mph, Barwick did not see Wareham in time to avoid the collision.

Judge Michael Chambers KC described the incident as a momentary lapse of concentration, emphasizing that Wareham was blameless and had the right of way on the pavement. Barwick, with an otherwise clean driving record and no prior convictions, was deemed fit to drive at the time. The court acknowledged her genuine remorse and the impact an immediate sentence would have on her at 95 years old.

In addition to the suspended sentence, Barwick was also banned from driving for 10 years.
