Activists Demand Overhaul of Windrush Compensation

After nearly nine years following the exposure of the Windrush scandal, activists have come together to request an immediate revamp of the compensation system. Survivors, along with Grenfell United, Hillsborough Justice families, Imran Khan KC, Brian Eno, and various civil rights groups, have collaborated to draft an open letter to the Lord Chancellor, Shabana Mahmood, urging the Government to extensively reform the Windrush Compensation Scheme.

They are aiming for a level of support akin to what Grenfell and Hillsborough received during their campaigns, where they successfully secured independent oversight and crucial legal assistance. The letter emphasizes the contributions made by the Windrush generation in rebuilding post-war Britain, highlighting the injustices they faced such as wrongful detention, deportation, denial of healthcare and employment, and the loss of citizenship, homes, and livelihoods due to the Hostile Environment policy.

Despite the government launching the Windrush Compensation Scheme seven years ago, it continues to fall short, as evidenced by recent findings from JUSTICE with the University of Sussex and Dechert LLP, revealing significant disparities. The letter includes cases where individuals initially offered minimal compensation by the Home Office saw substantial increases, reaching up to £170,000 and £295,000 with pro bono legal assistance.

Furthermore, the letter points out that 66% of applicants are initially denied any compensation, making the scheme’s success rate the lowest among major state redress programs. It also criticizes the lengthy 44-page application form, comparing it unfavorably to forms for other survivor groups.

The activists have outlined three key demands in their letter to the Government: transferring the Windrush Compensation Scheme from the Home Office to an independent body overseen by a judge or independent commissioner, providing non-means-tested legal aid for all claimants, and accommodating all losses while adopting a more lenient approach to evidence requirements.

In a joint statement, the signatories expressed their shared experiences of state betrayal and the prolonged fight for justice, emphasizing the need for reform to address past wrongs. The proposed changes offer hope for individuals like Carlton, a victim of the Windrush scandal who faced years of uncertainty and displacement.

Carlton, who arrived in the UK as a child in 1966, found himself denied re-entry after a trip to Barbados due to a lack of records relating to his status under the Windrush scheme. His sister, Deborah Trotman, highlighted the difficulties they faced in rectifying the situation and the emotional toll it took on their family.

Despite being identified as a Windrush victim in 2024, Carlton continues to reside in the Caribbean, as efforts are made to bring him back home through legal channels. Deborah’s persistence underscores the challenges faced by those affected by the scandal and the urgent need for a fair and efficient compensation process.

The ongoing struggles of individuals like Carlton serve as a stark reminder of the human cost of bureaucratic failures, prompting calls for comprehensive reforms to ensure justice for all impacted by the Windrush scandal.
