Court of Appeal Rejects Appeal in Yukon Sexual Assault Case

The appeal of a man challenging his sexual assault sentence in Yukon has been rejected by the Court of Appeal. Rudra Amin, now living in Calgary, was convicted in 2023 of assaulting three women in Whitehorse from 2017 to 2018. Following the victims’ report in 2020, Amin was found guilty of four counts of sexual assault after a trial by jury.

After being sentenced, Amin promptly appealed and was subsequently released on bail. In his appeal, Amin sought a reduction of two months from his slightly over two-year sentence to qualify for a conditional sentence order, citing concerns about potential immigration repercussions. However, Justice Susan Griffin, in her ruling on Aug. 6, dismissed the appeal. Griffin refuted Amin’s argument that the sentencing judge had erred and deemed Amin’s request for a conditional sentence inappropriate.

Griffin emphasized that Amin’s plea to shorten his sentence by two months lacked merit unless he could demonstrate a fundamental error impacting the sentence. “This is simply tinkering and not this court’s proper role,” reads Griffin’s decision. Consequently, Amin will serve his original sentence of slightly over two years.
