“Enhanced Consumer Protections for Buy Now, Pay Later Users”

Millions of consumers using buy now, pay later (BNPL) services will now receive enhanced protections as new regulations take effect on July 15. BNPL enables individuals to spread out the cost of purchases without interest over a specified period. The Financial Conduct Authority (FCA) estimates that around 11 million UK adults utilize this payment method, which, when managed responsibly, offers an affordable means of obtaining credit.

Despite its popularity, the BNPL sector has faced criticism due to the lack of oversight, leading to concerns about consumers accumulating unmanageable debt if they fail to adhere to their payment schedules. As a response, the FCA has moved to regulate the BNPL industry, requiring firms to obtain authorization from the regulator to provide BNPL agreements. These firms must conduct thorough credit and affordability assessments for each transaction to ensure customers can meet their repayment obligations.

Under the new rules, potential BNPL users may be denied credit if there are doubts about their ability to afford the debt. Additionally, customers will receive transparent information upfront regarding their agreement terms, payment deadlines, amounts, and consequences of missed payments. While most BNPL services do not charge interest, late fees can be applied for missed payments, and such incidents may be reported to credit agencies, potentially impacting credit scores.

In cases of financial difficulty, BNPL firms are now obligated to offer increased support, including directing individuals to free debt counseling services. Customers who encounter unfair treatment can file complaints with the Financial Ombudsman Service (FOS), providing an avenue for redress. Furthermore, shoppers now benefit from Section 75 protection, holding BNPL providers jointly accountable with merchants for faulty or undelivered items valued between £100 and £30,000.

Major BNPL players like Klarna and Clearpay have expressed support for the stricter regulations, emphasizing the importance of consumer protections and responsible lending practices. Klarna, for instance, highlighted its existing measures such as affordability checks and transparent cost disclosures, underscoring the benefits of the new rules in enhancing consumer confidence and strengthening access to safeguards.

Clearpay echoed similar sentiments, citing research indicating widespread public approval for the regulatory framework. The company affirmed its commitment to maintaining customer safeguards like account suspensions for missed payments and capped late fees while welcoming the additional protections now available, including Section 75 coverage and access to the Financial Ombudsman Service.

Sarah Pritchard, deputy chief executive at the FCA, emphasized the importance of ensuring responsible lending practices within the BNPL sector to protect consumers from financial distress. The FCA aims to strike a balance between fostering innovation in the industry and safeguarding the interests of the growing number of BNPL users.

These regulatory changes seek to establish a uniform operating environment for all BNPL providers, promoting transparency, affordability, and accountability. As the BNPL landscape evolves, the focus remains on maintaining a fair and sustainable credit ecosystem for millions of consumers relying on these services for their everyday financial needs.
