Halle Berry refutes accusations made by Olivier Martinez, her ex-husband, that she physically harmed their 13-year-old son, Maceo. The former couple is approaching an upcoming court date on Oct. 16 regarding custody and a restraining order.
Martinez has requested sole legal and physical custody of Maceo and a restraining order against Berry, citing an alleged violent incident towards their son on Sept. 26 and mentioning a history of abuse. Court documents obtained by CBC News reveal these claims.
On Oct. 1, a Los Angeles Superior Court judge granted a temporary restraining order, limiting Berry’s parenting time and mandating her to stay 100 yards away from Martinez until the hearing. The judge denied Martinez’s plea for monitoring Berry’s sobriety due to insufficient evidence.
Berry has vehemently denied the accusations, labeling them as “completely untrue” and asserting that she has never mistreated Maceo in any way. She characterized the incident on Sept. 26 as playful roughhousing that took a wrong turn into an argument. Berry is advocating for the restoration of their previous 50-50 custody agreement.
Berry and Martinez tied the knot in 2013, welcomed Maceo later the same year, and finalized their divorce in 2023 with a mutual custody arrangement.
In a legal battle update, Martinez sought a restraining order and sole custody on Oct. 1, alleging that Berry physically assaulted Maceo on Sept. 26. Nahla, Berry’s 18-year-old daughter from a previous relationship, defended her mother in a declaration, denying witnessing any abuse towards Maceo.
Berry contested Martinez’s claims on Oct. 4 through her legal representation, highlighting past violations of court orders related to their son’s welfare. Video evidence, according to Berry’s legal team, contradicts Martinez’s narrative.
On Oct. 5, Berry submitted her own declaration, refuting Martinez’s allegations and recounting the events of Sept. 26. She emphasized her stance against domestic violence, stating she is a survivor and advocate for victims. Berry explained the playful nature of the roughhousing with Maceo and denied any form of physical harm towards him. She expressed the importance of maintaining structure and contact with her son, advocating for the reinstatement of their 50-50 custody arrangement.
The next court hearing is scheduled for Oct. 16 to review the temporary restrictions and potential changes in custody arrangements.
