A man who has endured 23 years behind bars is claiming he was set up by law enforcement, according to newly uncovered evidence. Omar Benguit was handed a life sentence for the killing of South Korean student Jong-Ok Shin in Bournemouth back in 2002. Despite being a drug addict, Benguit was found guilty in 2005 after two previous trials resulted in hung juries.
Fresh findings brought to light by the BBC indicate that crucial witness testimonies in the prosecution’s case were contradicted by CCTV footage. Allegations have surfaced that 13 witnesses, many struggling with drug addiction, were coerced by the police to alter their statements or fabricate information for the court.
In response, Dorset Police defended their investigation, asserting that it was exhaustive and intricate. Benguit, now 53 and drug-free, maintains his innocence despite the impact on his chances for parole, stating firmly, “I’d rather die in prison claiming my innocence than be released on a lie.”
Calls have been made by retired murder squad detective Brian Murphy for an investigation by the Independent Office for Police Conduct into Dorset Police’s handling of the case. Benguit’s barrister, Des Jenson, highlighted the gravity of the situation, emphasizing that if witnesses were coerced into lying, it amounts to the fabrication of evidence and a perversion of justice.
One witness, identified as Leanne, recounted being pressured as a 17-year-old into signing a false statement, emphasizing the undue influence exerted on her by the authorities. The case against Benguit heavily relied on the testimony of a drug-addicted witness, known as BB, whose credibility has come under scrutiny due to inconsistencies in her accounts and contradictory evidence.
Further revelations suggest that the police had access to CCTV footage during the investigation that discredited the key witness’s narrative. Additional testimonies have emerged, implicating law enforcement in pressuring individuals to provide false information, raising serious doubts about the integrity of the case against Benguit.
The case of Jong-Ok Shin’s murder has been marred by a series of questionable decisions and oversights by the authorities. Despite mounting evidence pointing to a potential miscarriage of justice, the Criminal Cases Review Commission is currently evaluating the case for further review.
Dorset Police have defended their actions, noting that Benguit had already pursued and lost two appeals against his conviction. The force emphasized that any concerns regarding the conviction are now under the jurisdiction of the CCRC and the Court of Appeal.
