Caught on camera was the demeanor of a driver labeled as “arrogant” who caused the death of a young woman, seen smirking outside the courtroom just before his imprisonment.
Dean Tolan, aged 36, was filmed arriving at Sheffield Crown Court for sentencing after admitting guilt to the death of Ellie Smart, 29, due to reckless driving. In the footage, Tolan is observed using the hands-free feature on his phone while wearing a smirk. Additionally, he was witnessed engaging in light-hearted banter with others and carrying a sizeable overnight bag as he awaited entry into the premises.
Following the tragic incident in Sheffield on January 25, 2024, where he struck Ms. Smart at 58 miles per hour as she was crossing the road, Tolan was sentenced to nine years in prison. Further, he received a 10-year driving ban for not wearing his prescription glasses, despite the conditions of his license.
Judge Jeremy Richardson KC expressed his belief that Tolan, residing in Birley, Sheffield, exhibited a blatant disregard and arrogance towards regulations. The court was informed that Tolan was also using his phone just moments before the incident.
In a heart-wrenching statement to the court, the parents of Ms. Smart expressed their devastation at witnessing the tragic loss of their daughter shortly after the collision in January 2024.
Ms. Smart, a distinguished communications graduate employed in the office of South Yorkshire Police, had visited her parents on the morning of the fatal accident. Her parents, residing nearby, shared the emotional impact of feeling compelled to leave the city.
They lamented the fact that she will never experience marriage, have a family of her own, or witness her niece’s growth.
Prosecutor Laura Marshall highlighted that Tolan failed several roadside vision tests and falsely claimed to have noticed emerging eyesight issues only days before the tragedy.
During the proceedings, it was revealed that Tolan’s mobile phone was linked to his vehicle’s Bluetooth system, but records indicated its usage moments before the collision occurred.
Judge Richardson remarked, “Your behavior showcased remarkable arrogance; you demonstrated a lack of basic humanity during police interviews, attempting to shift blame to the deceased, DVLA, and your optician. Your actions led to the demise of a delightful 29-year-old woman with her whole life ahead. You extinguished that future.”
The court also heard how Tolan tried to deflect blame onto Ms. Smart after her passing, alleging that she suddenly darted in front of his vehicle without giving him a chance to brake.
