A woman who lost a legal battle with her daughters over a £1 million-plus settlement post-divorce has managed to secure a second court appearance. Camilla Bains and her daughters have faced significant turmoil as a family following Camilla’s divorce. Despite a previously close relationship, tensions arose when Camilla transferred assets to her daughters to maintain her benefits, including setting fire to documents concerning her property ownership. When Camilla attempted to reclaim the house and funds from her daughters, legal proceedings ensued.

After an initial ruling in favor of the daughters, a recent High Court decision granted Camilla the opportunity to challenge the previous judgment due to her dire financial situation resulting from the dispute. Her lawyer highlighted the unfairness of Camilla being left with nothing and emphasized her complete dependence on welfare benefits.

The legal battle stems from a prolonged divorce settlement process that concluded in 2019, where lump sum payments from Camilla’s ex-husband were directed to her daughters instead of her directly. Despite owning a home in Rosehill Gardens, Sutton, Camilla sought to move due to proximity to her ex-husband, leading to the acquisition of a new property in her daughter’s name. The disagreement escalated when Camilla contested the house ownership and financial arrangements post-divorce.

The recent court proceedings focused on a note signed by Camilla in August 2019, indicating a relinquishment of her stake in the property to her daughter. However, Camilla’s legal team argued that the note was not a formal transfer of ownership and lacked evidence of her prior written consent to relinquish her interest. Furthermore, they contended that the note did not clearly specify the recipient of Camilla’s interest in the house.

Permission for a full appeal was granted by the High Court judge, recognizing the potential validity of the arguments presented. The case is set to return to court for a comprehensive review of Camilla’s appeal at a later date.
