ABC Files First Amendment Lawsuit Against FCC

ABC has filed a lawsuit against the Federal Communications Commission (FCC) on First Amendment grounds, accusing the agency of jeopardizing its operations by demanding early review of broadcast licenses. The lawsuit, involving ABC, Disney (its parent company), and eight local stations, aims to halt the early renewal process ordered by FCC Chairman Brendan Carr, an ally of President Donald Trump. The FCC’s decision to review ABC’s licenses ahead of schedule was linked to the network’s diversity practices but followed a controversial joke made by ABC’s late-night host Jimmy Kimmel, who is known for criticizing Trump.

In response to what it perceives as an “existential threat” posed by the administration’s actions, ABC stated that the lawsuit is a necessary step to protect its First Amendment rights amid escalating attacks on its freedom of speech. The network emphasized that it had no option but to seek legal intervention to counter the administration’s alleged retaliation against its broadcasting licenses.

This legal battle is part of a larger conflict between ABC and the FCC, with ABC also contesting efforts to subject “The View,” a morning talk show critical of Trump, to equal-time rules. The lawsuit highlights broader implications beyond ABC, warning that the administration’s stance on free speech could set a dangerous precedent for media companies nationwide.

Anna Gomez, the sole Democrat on the commission, praised ABC and Disney for challenging the FCC’s actions, describing the campaign against Disney’s ABC stations as a form of censorship and control. In contrast, Carr defended the FCC’s position, emphasizing broadcasters’ obligation to operate in the public interest and restore trust in the news media.

The FCC reiterated its stance that all broadcasters, including Disney, must fulfill their public interest obligations, citing ongoing examinations of diversity and inclusion practices within Disney. The FCC affirmed its commitment to upholding the law and investigating any allegations of wrongdoing within the broadcasting industry.
