“Thunder Bay Seniors’ Building Faces Legal Action for Health Violations”

Published on

The Thunder Bay District Health Unit (TBDHU) has resorted to legal action against the owner of a seniors’ apartment building due to numerous health code violations that were left unaddressed. Abby Mackie, a public health inspector at TBDHU, mentioned that after complaints about issues such as excessive heat, overflowing garbage, and bedbugs at Vickers Manor, compliance orders were issued to SMS Property Trust Inc. on July 8 and July 29.

Vickers Manor, previously known as McKellar Place, provides independent living units for seniors and a dozen assisted living units managed by Brain Injury Services of Northern Ontario. Situated at 325 Archibald St. S. in Thunder Bay, the property is currently listed for sale at $1, down from its earlier listing price of $18.9 million.

Aside from health code violations, the owner is also facing numerous fire code violations. Delinquent bills almost led to utility shutoffs, prompting volunteers to start a crowdfunding campaign to supply meals to residents after hot meals ceased.

SMS Property Trust Inc., owned by Ongrasothy Masillamany of Markham, is facing 36 offenses under the Health Protection and Promotion Act related to excessive heat in the building. The owner is summoned to appear in court, with a hearing scheduled for November 25.

Vaugeois, the Thunder Bay—Superior North NDP MPP, has called on the province to investigate the situation at Vickers Manor, emphasizing the need for proper housing enforcement. The City of Thunder Bay is actively monitoring the situation to prevent service disruptions that could endanger tenants.

Residents at Vickers Manor, like Sharon Zoschke, express their attachment to the community despite challenges. Zoschke, who moved to Thunder Bay from Ottawa, remains hopeful for a positive resolution and stresses the importance of transparent communication with tenants regarding potential changes in services and the property’s sale.

Zoschke encourages a supportive approach from the community towards Vickers Manor tenants, highlighting the significance of maintaining faith during difficult times.
